BUSINESS ENERGY EFFICIENCY SURVEYS (BEES) PROGRAM
Terms & Conditions
- I understand, acknowledge, and agree to the Terms and Conditions outlined herein, which are integral to the application form for my participation in the Business Energy Efficiency Surveys (BEES) Program.
- I understand that the Program is available to all eligible commercial customers of Southern California Gas Company (“SoCalGas”) who maintain an active service account with a functioning SoCalGas meter and whose service address is located within Los Angeles County, San Bernardino County, Orange County, or Riverside County, provided they use less than 50,000 terms annually.
- I understand that the Program, including its application requirements and any energy efficiency products, systems, or improvements (“Equipment”) offered, may be changed, or discontinued at any time without prior notice. Additionally, information, results, and reports related to your participation in the Program may be shared with the California Public Utilities Commission (“CPUC”).
- I acknowledge that the Program and these Terms and Conditions may be updated at any time without prior notice. In such cases, unless otherwise restricted by applicable law or any directive from the California Public Utilities Commission (CPUC), applications that have been signed will be processed according to the Terms and Conditions in effect on the date of their signing.
- I understand that the Program may conclude before the specified end date of 03/31/2026 if allocated funds are exhausted. Equipment purchases and installations made before or after this specified term will not be eligible for rebates, incentives, or services. Due to limited Program funds, applications are processed on a first-come, first-served basis, based on the order of receipt, until funds are no longer available. Eligibility for rebates, incentives, and services is determined by the date the application is received. Incomplete or incorrect applications cannot be processed. Resubmitted applications will be handled on a first-come, first-served basis according to their new receipt date. If the rebate or incentive amounts change during the Program period, the eligibility and rebate or incentive amount will be based on the order/purchase date and/or application postmark. Rebate and incentive offerings and amounts may be modified without prior notice throughout the Program term. Deemed Projects: To receive a rebate, applications must be submitted, approved, and installed within twelve (12) months of the purchase date. Exceptions to this requirement must be documented in writing and are granted solely at SoCalGas’s discretion. For Custom Projects: To receive an incentive, (1) a completed application must be submitted and approved before ordering equipment, and (2) an executed Conditional Incentive Reservation (CIR) form must be obtained prior to equipment installation (the equipment cannot be connected to a natural gas line until the CIR form is executed).
- I certify that I have not received any rebates, incentives, or services for the same equipment from any other California Investor-Owned Utility (IOU), or from any state or local third-party energy efficiency program funded by the Public Purpose Program Surcharge (PPPS). I acknowledge that I am ineligible to receive rebates, incentives, or services for the same equipment from more than one California IOU participating in this Program, or from any other third-party programs offering rebates, financing, or incentives funded by the CPUC. Additionally, I understand that I cannot receive rebates, incentives, or services for any equipment for which I have already received such benefits from SoCalGas within the five (5) years preceding the application date. Equipment that has received a SoCalGas rebate or incentive at the point of sale, as an instant markdown, through a Regional Energy Network or Home Upgrade Program, or from a manufacturer or distributor, does not qualify for a mail-in or online rebate, incentive, or service.
- I understand that the total amount of any rebates and/or incentives cannot exceed the actual purchase price of the equipment (or the maximum allowance per unit), which includes the cost of materials and installation labor but excludes taxes and shipping costs. Business Energy Efficiency Surveys (“BEES”), e.g., ICF Resources, LLC (“ICF”)] and SoCalGas reserve the right to limit the number of units eligible for rebates or incentives. Customers who perform self-installation may not charge for installation labor. I agree to remove and dispose of the replaced equipment in compliance with all federal, state, and local regulations.
- I understand the following about the report findings:
- The estimated natural gas rebate presented in the report is subject to change and will vary by each program.
- The payback period includes the estimated natural gas rebate and may change depending on program selected.
- The equipment replacement costs may vary due to make and manufacturer selected.
- The savings in the report are estimated based on existing equipment, proposed equipment, business type, climate zone and other factors.
- This report is for informational purposes only. I certify that the installed qualifying equipment complies with all applicable federal, state, county, city, and local laws, regulations, and building codes, including any requirements set by homeowner’s associations (if applicable), manufacturer’s specifications, and permitting requirements. I understand that the energy-efficiency level of the qualifying equipment, as defined in the specification sheet, determines the rebate and/or incentive amount. If a contractor performed the installation or improvement, I confirm that the contractor holds the necessary license for the work conducted.
- I understand that rebate and/or incentive payments are based on the energy benefits provided by the equipment over its lifetime. I agree to keep the equipment specified in this application: (1) fully functional for the duration of the equipment’s life or for five (5) years from the receipt of rebate and/or incentive funds, whichever is shorter; and (2) remain a customer of SoCalGas during this period. Should either condition not be met, I agree to refund a prorated amount of the rebate and/or incentive funds to SoCalGas based on the actual period during which the energy benefits were provided as a SoCalGas customer. I certify that all equipment was purchased new and understand that equipment that is resold, leased, rebuilt, refurbished, purchased at auction, rented, received through insurance or warranty claims, won as a prize, received as a gift, or purchased with reward points, as well as new parts installed in existing products, does not qualify. Rebates and/or incentives will only be issued for equipment that meets the specifications of the Program.
- I certify that the information provided in this application is accurate and that the IRS Tax ID number provided is correct. I understand that rebates and/or incentives may be taxable, and I am advised to consult with my tax advisor regarding the tax implications of any rebates or incentives received through this Program. Rebates and/or incentives exceeding $600 will be reported to the IRS on Form 1099, unless I have indicated that I am a corporation or have tax-exempt status and have noted this status in the application. Neither SoCalGas nor RHA is responsible for any taxes that may be imposed on me or my business as a result of receiving these rebates or incentives.
- I understand that RHA is an authorized contractor of SoCalGas responsible for implementing the Program until [month/date/year]. I acknowledge that the installation of the equipment may require RHA and/or its authorized subcontractor, [Subcontractor name], to access my facility. I agree to allow RHA and its authorized subcontractors to: (1) Review the completed and signed application; (2) Install the qualifying equipment; and (3) Verify the installation of the equipment at my facility, as necessary.
- I understand that neither SoCalGas nor RHA shall have: (1) any obligation to maintain, remove, or perform any work on the installed equipment; or (2) any liability arising from the contractor’s installation of the equipment, including any failure of the equipment to function properly, any damage to my premises caused by the contractor, or any property damage or personal injury resulting from the equipment.
- I understand that all projects are subject to evaluation studies and program measurements conducted by external contractors appointed by the California Public Utilities Commission (CPUC). These studies are intended to analyze and enhance the performance of the Program. I agree to participate in these evaluations by responding promptly to any inquiries from the contractors.
- I agree to allow reasonable access to the property where the equipment is installed, if requested, by representatives from SoCalGas, RHA, the CPUC, and/or any authorized third parties to verify the equipment before the rebate and/or incentive is paid. I understand that if I refuse to participate in any required verification, no rebate or incentive will be issued. Additionally, I understand that SoCalGas, RHA, the CPUC, and/or any authorized third party may contact the equipment vendor and/or installer to verify the purchase and installation of the equipment and may share my name and/or address for this purpose. This inspection aims to ensure that the installed equipment meets all Program requirements. I acknowledge that rebate and/or incentive applications submitted to SoCalGas may be randomly selected for inspection to ensure compliance with Program and quality control standards, and that a virtual video or in-person inspection, along with Geo-Tagged photos, may be requested to verify the equipment installation prior to payment.
- I acknowledge that I have been informed of SoCalGas’s California Consumer Privacy Act (CCPA) Policy. Personal information may be collected as part of this process. For more details, I can review SoCalGas’s CCPA Notice at Collection by visiting socalgas.com/CCPA.
- I hereby certify that I am authorized to make this declaration as the Customer or as an authorized representative of the Customer. I attest that, to the best of my knowledge, the existing equipment being replaced is in operating condition. I understand that any misrepresentation may result in the rejection of all or part of the project, and the Customer may be required to return any incentives associated with this project. Furthermore, I acknowledge that any misrepresentation may lead to additional scrutiny of future projects submitted by the Customer and could result in probation or suspension from current and future incentive programs.
- HVAC Workforce Standard Qualification Requirements: Pursuant to CPUC Decision (D.)18-10-008, effective July 1, 2019, I certify that if my project involves the installation, modification, or maintenance of [non-residential] heating, ventilation, and air conditioning (HVAC) measures and I am applying for an incentive of $3,000 or more, the project has been (or will be, upon completion) executed by technicians who meet at least one of the following qualifications: (1) Completed a California or federally accredited HVAC apprenticeship program;(2) Are currently enrolled in a California or federally accredited HVAC apprenticeship program;(3) Have at least five (5) years of work experience at the journey level as defined by the California Department of Industrial Relations (Title 8, Section 205, of the California Code of Regulations), passed a practical and written HVAC system installation competency test, and received credentialed training specific to the technology being installed; or(4) Have at least five (5) years of work experience at the journey level as defined by the California Department of Industrial Relations (Title 8, Section 205, of the California Code of Regulations), passed a practical and written HVAC system installation competency test, and received credentialed training specific to the technology being installed; or Hold a C-20 HVAC contractor license from the California State Contractor’s Licensing Board. Before any HVAC measures are installed, modified, or maintained, each technician performing the work has provided (or will provide) the necessary qualification documentation for HVAC Measure Installation Qualification, which will be included in the application form.
- I acknowledge that the selection of equipment, contractor, manufacturer, dealer, supplier, and/or installer, as well as the purchase, installation, ownership, and maintenance of the equipment referenced in this application, are solely my responsibility. SoCalGas makes no representation, qualification, endorsement, or guarantee regarding any of these choices. Furthermore, I understand that the contractor, manufacturer, dealer, supplier, or installer of the equipment is not an agent or representative of SoCalGas or RHA. SoCalGas makes no warranties, express or implied, including any implied warranty of merchantability or fitness for a particular purpose, use, or application of the equipment or related energy efficiency measures, and expressly disclaims any such warranties. I acknowledge that I am under no obligation to purchase any additional goods or services from any contractor due to my participation in this Program. I understand that any warranties I may rely on are limited to those provided by the contractors or vendors supplying goods or services in connection with the equipment. Neither SoCalGas nor RHA are responsible for ensuring that the design, engineering, or construction of the facility or the installation of the equipment are appropriate or comply with any specific laws (including patent laws), codes, or industry standards. Additionally, neither SoCalGas nor RHA make any representations regarding the results that the equipment may achieve or the adequacy, safety, reliability, or efficiency of the equipment.
- I agree that SoCalGas has no liability whatsoever regarding: (1) The quality, safety, performance, or any other aspect of the design, system, energy efficiency equipment installed under the Program, including their fitness for any particular purpose; (2) The estimated energy savings of the equipment; (3) The workmanship of any third parties involved; (4) The installation or use of the equipment, including but not limited to its impact on indoor pollutants; and (5) Any other matters related to the Program.
- I waive any and all claims against SoCalGas, its parent company, affiliate companies, directors, officers, employees, or agents (collectively, “SoCalGas Parties”) arising from activities conducted by or on behalf of SoCalGas in connection with my application for any rebates, incentives, or services under the Program. Furthermore, to the maximum extent permitted by law, none of the SoCalGas Parties, RHA, or their respective affiliates shall be liable to me or any other party for any damages—whether direct, indirect, special, consequential, exemplary, reliance-based, punitive, or incidental—including damages for loss of use. This limitation of liability applies regardless of the theory of recovery, whether in contract, indemnity, warranty, strict liability, or tort, including any form of negligence. Additionally, to the maximum extent permitted by law, I agree to indemnify the SoCalGas Parties against all losses, damages, expenses, fees, costs, and liabilities arising from any claims related to the use of any equipment installed or services performed during the installation or maintenance of such equipment as referenced in my application for any rebates or incentives under the Program.
